One of the first houses I bought on my own was an interesting case.  The homeowner was an older man, probably early 70’s, that called himself “Rocky” as a nickname.  I’ve met many people in my life that I would characterize a Rocky, but this fellow was not one of them.

 

He was maybe 5’ 2” and 130 lbs.  He was looking to sell his house quickly because he wanted to move in with his ailing brother that lived about an hour away.  Rocky and I agreed to terms and decided to move to the next step.

Rocky had inherited the house from his Mom, and instead he decided to use the local attorney that had handled the estate.  This was mistake number 1.

As things started dragging out, Rocky decided to move out to his brother’s house before the closing took place.  This was mistake number 2. 

 

As time passed and everyone started becoming impatient with the lack of progress, Rocky started to call his attorney from his brother’s house regularly to push him a bit.  This ended up having the opposite effect and ultimately the attorney stopped picking up the phone or returning calls at all.  When Rocky lived right near the attorney’s office it was easy for him to just jump in the car and stop off there if he had a question or problem. Now, being an hour away, that was not easy.

 

frustrated - get proper legal representation when selling your houseAs weeks started to turn into months without any progress, Rocky was left no alternative but to get in the car and drive an hour to confront his attorney and try and get the transaction completed.

 

He didn’t even know when the attorney would be there, so he would leave his brother’s house early in the morning, drive the hour, and sit in his attorney’s office until he showed up.  His stress level was unnecessarily high, and he had to leave his sick brother alone every time he went to the attorney’s office.  After having to do this maybe five or six times, he was finally able to pin down his attorney often enough to get everything ready for the closing.

 

We eventually closed the transaction, but not without a tremendous amount of unnecessary stress and anxiety.  If Rocky had been more careful and selective about the professional he hired to represent him. his life would have been much easier.  And, he would have closed much faster.

 

selling a house and getting a legal representation from a real estate attorneyThis lesson truly applies to anyone that needs to hire a pro.  That could be a pro of any kind, in any field.  Don’t pick someone because it’s easier or you like their personality.  Hire the person who is best suited for the task.  Usually, that is a specialist, rather than a generalist.  (Remember the phrase Jack of All Trades, Master of none?)  Do your due diligence before selecting someone to do business with and go with the most qualified professional you can find.
